SUPERVISOR RESPONSIBILITIES
Supervisors and other designated personnel are responsible for taking appropriate steps to address health and safety concerns at the mine site. To ensure compliance, the following requirements apply:
Supervisors may not interfere with, obstruct, or delay any investigation or inspection conducted under the Mine Act.
Supervisors are required to grant access to authorized representatives, including MSHA inspectors or investigators, for the purpose of conducting inspections or investigations at coal, metal, or nonmetal mines.
Supervisors must provide access to requested records and allow copies of any documents needed during an investigation or inspection.
FAMILIARITY WITH CODE VIOLATIONS
Directors, officers, and agents of a mining company have additional obligations under Section 110(c) of the Mine Act. These responsibilities include the following:
They must not knowingly authorize, direct, or carry out any violation of mandatory health and safety standards.
They must not knowingly violate or fail to comply with any order issued by MSHA or included in a final decision under the Mine Act.
Failure to meet these obligations may result in civil penalties, monetary fines, and potential imprisonment.
